Now here's some more information about assault charges in New Jersey.

Simple assault is the lowest level of assault under New Jersey criminal law. The governing statute for simple assault is NJSA 2C:12-1. There are three different categories under which a person can be charged. The first part talks about a situation where it is suspected that someone tried to cause or intentionally, knowingly or deliberately to injure someone. The second part deals with a situation where it is suspected that a person was negligent and injured another person by using a deadly weapon. The third and final section deals with situations in which a person who is suspected of physical danger attempts to put another person in fear of serious bodily injury.

All categories are considered misdemeanors, unless the incident is classified as "fighting", it will be considered a minor conflict crime. Disorderly conduct is a New Jersey type of crime. All minor charges will be filed in the municipal court in the town where the incident occurred. So, for example, if a person is arrested and charged with a minor at Rider University, their charges will be forwarded to Lawrenceville Municipal Court for sentencing. A misdemeanor conviction will remain on a person's record for at least three years before they can petition the court to have it expunged.

Simple Vs. Aggravated Assault Charges

All charges, regardless of the category a person is charged with, are considered a felony, which is the New Jersey version of the felony. Depending on the specific category a person is accused of, they may face a second, third or fourth degree. The type of injury caused or attempted (bodily injury, serious bodily injury or serious bodily injury) and the position of the victim (police, EMS or firefighter) will be more likely than not to help in determining the specific level. Unlike simple assault charges, all assault charges must be forwarded to Mercer County Superior Court, located in Trenton Township, for adjudication. Therefore, if a defendant is charged with criminal trespassing in TCNJ, the crime must be transferred from the Ewing Municipal Court to the Mercer County Superior Court for sentencing.

Depending on the standard, a person charged with aggravated assault could face up to ten years in prison and a $150,000 fine. In addition, a conviction for such a crime will remain on a person's record for at least six years, during which time they still have to file a lawsuit to be sentenced.

Simple Assault Charge

Regardless of whether the person is charged with a misdemeanor or a misdemeanor, if the incident is classified as domestic violence, the victim will be able to seek a temporary restraining order in addition to the criminal charge. If this happens, the person will not only defend himself from the charges against him but also prevent him. Restraining orders are separate and apart from criminal charges and will be contested in the Chancery Division, Family Division of Mercer County Superior Court.
